OPTIONS FOR APPEALING YOUR DENIAL OF YOUR VA BENEFITS CLAIM

If your VA benefits claim was denied on or after February 2019, the Veterans Appeals Improvement and Modernization Act of 2017 gives you three options for appealing the adverse decision:

  • Higher-Level Review – You can ask an adjudicator with more experience at the VA to review your claim for any errors made by the initial reviewer. The more experienced adjudicator will review your claim as it was initially submitted without giving any deference to the original reviewer’s decision.
  • Supplemental Claim – With this appeal option, you can provide the VA with evidence that is both new and relevant that the VA did not consider previously. Upon receiving this new and relevant evidence, the VA will then reevaluate your claim and determine if you qualify for benefits based on the new information.
  • Board of Veterans’ Appeals – This appeal option permits you to have your claim reviewed to the Board of Veterans’ Appeals. If you choose this option, you can ask that a veterans law judge perform a direct review and consider your claim based on the evidence already submitted to the VA. You may also ask to submit new and relevant evidence to your claim before being reviewed by a veterans law judge. Finally, you may ask to submit new and relevant evidence and have all the evidence in your claim considered by a veterans law judge at a direct hearing.

If your VA benefits claim was denied prior to February 2019, you can continue using the old “legacy” appeal system or you can choose to make use of these new appeal options.

Choosing the appropriate appeal option for your case means considering the reasons why your VA benefits claim was denied. And no matter which option you choose, there are strict timelines that you must comply with or risk having your appeal dismissed and starting the application process over again.
